Partner, Douglas Mirell spoke on the PLI Panel for Rights of Privacy/Rights of Publicity and Commercial Speech in the Age of AI.
As reported by PLI:
“Panelists spoke about the increasing ability of AI to generate realistic copies of people’s faces, voices, and styles is a challenge to both personal privacy and commercial publicity. Many people are calling for there to be new causes of action for using AI-generated copies of real people. Actors are facing new (and old) contract language allowing for generated look-alikes and sound-alikes, and explore First Amendment issues in AI-generated commercial speech. After completing this session, participants will have a greater understanding of:
* The NO FAKES Act and similar legislation implementing property rights in personal identity
* Application of right of publicity laws to AI-generated content featuring celebrities
* Emerging guidelines on the use of AI in advertising and marketing
* Contract issues related to performing artists”
